LEGO TECHNICAL FALLACY

Lego Technical Fallacy

consists of Legal Fallacy + Technical Fallacy

So, If you pose a challenge before the court that a complaint made against you by opposite party suffers from both legally & technically based wrong notions then that complaint suffers from lego-technical fallacy.

Remember that, a legally wrong complaint can be allowed by a judge using his discretionary powers in good faith. Similarly, acting in good sense, the same judge can also allow a technically invalid complaint BUT when a complaint against you suffers from both legal & technical fallouts/ wrongs/ invalidity then the judge even in good faith can NOT ratify it because in that case he has acted against the law & also acted against the technicality. Hence, lego technical fallacy is an important legal terminology coined by the famous 498a fighter Hon'ble Atur Chatur Sir. This also marks the beginning of a new era in fight against gender discrimination in India. It is important3to note here that the lego technical fallacy concepts can be applied to any country laws where democratic & secular set up is followed in judiciary.

Examples of Lego-Technical Fallacy:-
A Wife files false complaint under her maiden name i.e., changes back to her maiden name without getting divorce.
LAW IS NOT A KEEP / CONCUBANT OF A WIFE & hence the law does NOT allow a wife or anyone to file a court case by concealing his/her true legal identity which is also known as identity fraud. I filed complaint against my husband in SPUWAC at Bombay. Can I withdraw this complaint? Can I return the FIR? This complaint was filed last month and only two dates have happened. Is there any possibility of settlement as my advocate is not allowing me to settle the matter with my husband.

My wife lied about the date of crime reported by her in FIR. Such crime never happened and as per call records or mobile tower location she was NOT in Delhi on the day of that crime. I even have phonic conversation records as she was talking to my cousin on that day from bangalore and my cousin was in Patna, And I was in J&K on the date of such event. And exactle same crime has been included with date in her CrPC 125 and Domestic Violence and Divorce cases filed by her. IO is paying deaf ears to all this. Any suggestions,

I am a NRI, and was married in year 2015. Once we started living together, she also showed disinterest in intercourse from the very beginning. Within six months, we started having small arguments (mostly about her irresponsible behaviour towards making a career). She told that she does not wish to become house wife. Despite my complete support, she always showed lack of interest in making her career of join any job in USA as a NRI. One day, she told her SISTER, and they first abused my parents and then myself. then, few days later, i.e., three weeks ago she went home to India saying she would be back in 45 days. Once she reached India, she cut off every communication from me. Today, I came to know that her family has filed dowry case against me in police women cell. She is planning to go for divorce and would file 498A.

As I am living abroad in USA as a NRI and I am about to get Citizenship very soon, and therefore making visits for such a cruel case would be quite problematic.

I want to ask if a matrimonial case under Section 9, Hindu Marriage Act, will be able to help me either in restoring my marriage or as a safeguard against 498A? Can I use the services of Atur Chatur himself write my petition or at least prepare a rough draft based on which I can get it filed directly in court by my relative in India through PoA (Power of Attorney). Please guide me what to do at this stage?
